골때리는 형수취수법이 나오는 신명기 25장

신명기 25장은 공정한 재판과 형벌, 거래의 정의를 강조합니다. 약자 보호와 도덕적 규범을 제시하며 아말렉의 악행을 기억해 멸하라는 명령으로 마무리됩니다. 특히 공정한 잣대로 공정한 무게추로 장사를 해야 장수를 한다네요.

매질은 40대 미만

1. "If there is a dispute between men and they come tinto court and the judges decide between them, acquitting the innocent and condemning the guilty, 2 then if the guilty man deserves to be beaten, the judge shall cause him to lie down and be beaten in his presence with a number of stripes in proportion to his offence. 3 Forty stripes may be given him, but not more, lest, if one should go on to beat him with more stripes than these, your brother be degraded in your sight.

 

법은 공정한 판단을 내려야 한다면서 범죄자의 매질을 40대 이상은 때리지 말라고 합니다. 역으로 원한을 살 수 있다는 것 같은데요. 돌로 처 죽이라는 명도 서슴없이 하면서 매는 40대 미만으로 하라는 게 좀 이상합니다. 돌로 처죽일만한 상황은 우상숭배나 간음, 부모를 저주하거나 때리고 살인이나 고의적 반역에만 해당하는데요. 인간들끼리의 분쟁은 40대가 마지노선인가 봅니다.

 

 

 4. "You shall not muzzle an ox when it is treading out the grain.

 

4절 소가 곡식을 밟을 때는 그 입을 막지 말라고 합니다. 이는 힘쓰는 자의 입을 막지 말라, 수고한 자가 당당히 누리게 하라, 등 일하는 자들의 공정한 보상을 의미합니다. 이 구절은 독특하면서 상당히 인기가 많은데요. 신약에서 바울이 두 번이나 인용해서 더욱 유명해진 구절이라고 합니다.

형수 공유라니 형수취수법

 

 

5. "If brothers dwell together, and one of them dies and has no son, the wife of the dead man shall not be married outside the family to a stranger. Her husband's brother shall go in to her and take her as his wife and perform the duty of a husband's brother to her. 6 And the first son whom she bears shall succeed to the name of his dead brother, that his name may not be blotted out of Israel. 7 And if the man does not wish to take his brother's wife, then his brother's wife shall go up to the gate to the elders and say, 'My husband's brother refuses to perpetuate his brother's name in Israel; he will not perform the duty of a husband's brother to me.' 8 Then the elders of his city shall call him and speak to him, and if he persists, saying, 'I do not wish to take her', 9 then his brother's wife shall go up to him in the presence of the elders and pull his sandal off his foot and spit in his face. And she shall answer and say, 'So shall it be done to the man who does not build up his brother's house.' 10 And the name of his house shall be called in Israel, 'The house of him who had his sandal pulled off.'

 

우리나라 야당 대표는 형수에게 쌍욕을 한 것으로 유명한데 성경에는 형수를 공유하라는 뜨악하는 내용이 나오네요. 형과 결혼한 형수가 죽게 되면 동생이 형수를 보살피는 차원으로 데리고 살아야 한다고 합니다. 그리고 형의 대를 잇는 자식을 낳아야 하는데 동생이 형수와 결혼하기 싫다고 한다면 마을 장로들 앞에 정중히 거절 의사를 밝힙니다. 그러면 형수가 도련님이 나랑 결혼 거절했다고 선포하면 사람들이 그의 얼굴에 침을 뱉는 수치를 당한다고 합니다. 그럼에도 불구하고 싫은 건 싫은 거니까요. 

 

 

하지만 반대로 동생이 형수가 좋아서 형을 살해했을 수도 있다는 전제도 생각해야 할 것 같습니다. 아마도 그래서 당시 법 규정 같은 게 이런 부작용이 있어서 제정한 것도 있지 않을까 싶습니다.

오죽했으면 잡았겠냐

 

11 "When men fight with on e another and the wife of the one draws near to rescue her husband from the hand of him who is beating him and puts out her hand and seizes him by the private parts, 12 then you shall cut off her hand. Your eye shall have no pity.

 

부부가 싸움을 했을 때 여성이 남성의 음낭을 잡으면 남편은 여자의 손을 자를 수 있다고 합니다. 아니 자른것도 아니고 움켜쥔 것 가지고 무엄하다고 자르다니요. 대를 잇는 중요 부품, 아니 부위를 건드려서 그렇다고 하는데 말입니다. 여자가 오죽했으면 거기를 잡았겠어요. 이건 백 프로 바람을 펴서 그런 거잖아요. 질투나 배신감 때문에 그런 것일 텐데도 마치 그런 걸 아는 것처럼 법으로 정해두었네요. 여자가 오죽했으면 잡았을까, 하는 생각은 안 하고 손을 자른다는 게 참으로 괘씸한 법이네요.

13 "You shall not have in your bag two kinds of weights, a large and a small. 14 You shall not have in your house two kinds of measures, a large and a small. 15 A full and fair weight you shall have, a full and fair measure you shall have , that your days may be long in the land that the Lord your God is giving you. 16 For all who do such things, all who act dishonestly, are an abomination to the Lord your God.

 

 

이미 출애굽기 20장이나 신명기 5장에도 장수에 관한 이야기가 나오는데요. 하나님을 믿고 따르면 천국에 가는 줄 알았더니만 장수를 보장한다는 것이 놀랍습니다. 그리고 이 구절에 장수는 공정한 저울추를 써야 장수한다는 것입니다.

아말렉이 한 짓을 기억해

 

17 "Remember what Amalek did to you on the way as you came out of Egypt, 18 how he attacked you on the way when you were faint and weary, and cut off your tail, those who were lagging behind you, and he did not fear God. 19 therefore when the Lord your God has given you rest from all your enemies around you, in the land that the Lord your God is giving you for an inheritance to possess, you shall blot out the memory of Amalek from under heaven; you shall not forget.

 

출애굽기 17장에 나온, 이스라엘 백성이 이집트 탈출하며 나가는 데 에서의 자손 아말렉이 이스라엘인들을 약탈한 것을 잊지 말라는 겁니다. 유목민, 그냥 산적으로 살던 이들의 흉포했던 짓을 기억하라는 거죠. 그래놓고 지들은 더한 짓을 했으면서 말입니다.
